Terms of Service

Welcome to Loosen. These Terms of Service ("Terms") govern your access to and use of the Loosen mobile application (the "App") and related services. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Given our initial launch focus in the European Union (EU), these Terms are designed with EU consumer protections in mind, while complying with laws in other regions like the US. If you have questions, contact us at hi@stretcha.co.

1. Account Terms

1.1 Eligibility

You must be at least 13 years old to use the App (16+ in the EEA for certain consents). By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to agree to these Terms. If you are under 18, we recommend reviewing these Terms with a parent or guardian.

1.2 Account Creation

To access features like personalized routines and progress tracking, you must create an account using your email. You agree to provide accurate information and keep it updated.

1.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at hi@stretcha.co of any unauthorized use or security breach. We are not liable for losses from your failure to secure your account.

1.4 Account Termination

You may delete your account anytime via Settings > Delete Account, which also erases your data (see our Privacy Policy). We may suspend or terminate your account for violations of these Terms, fraudulent activity, or harm to the App or users. For EU users, terminations comply with consumer rights and include notice where required.

2. Subscription Terms

Loosen offers free basic features and premium subscriptions for advanced routines, custom builders, and ad-free access.

2.1 Subscription Plans

Plans, pricing, and features are displayed in the App and may change with notice. Current details are available at signup.

2.2 Free Trial

We may offer a free trial. If you don't cancel before it ends, you'll be charged automatically. Cancel anytime during the trial without cost via your app store settings.

2.3 Billing and Auto-Renewal

Subscriptions renew automatically unless canceled. Charges are handled through your Apple App Store or Google Play account. For EU users, we provide clear pre-renewal notices as required by law.

2.4 Cancellation

Cancel anytime via your app store settings—effective at the end of the current period. You retain access until then. For EU users, you have a 14-day right to withdraw from the initial subscription without reason.

2.5 Refunds

Refunds follow Apple/Google policies—we don't process them directly. Contact your app store for requests. For EU users, refunds align with consumer rights directives.

3. Acceptable Use

3.1 Permitted Use

Use the App for personal, non-commercial purposes like following stretching routines, tracking progress, and building custom sessions.

3.2 Prohibited Activities

You agree not to:

• Use the App unlawfully or in violation of these Terms.
• Reverse engineer, decompile, or hack the App.
• Remove or alter copyrights, trademarks, or notices.
• Access others' accounts without permission.
• Disrupt servers, networks, or other users.
• Use automated tools (e.g., bots) to access the App.
• Resell, redistribute, or commercially exploit content.

We may investigate violations and cooperate with authorities.

4. Intellectual Property

4.1 Ownership

The App, including routines, illustrations, text, graphics, and software, is owned by Loosen and protected by copyright, trademark, and other intellectual property laws worldwide.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes. This doesn't include copying, modifying, or creating derivatives.

4.3 Feedback

Feedback you provide grants us a royalty-free, perpetual license to use it without compensation.

6.1 Disclaimer of Warranties

The App is provided "as is" without warranties, express or implied (e.g., merchantability, fitness). We don't guarantee uninterrupted, error-free, or virus-free operation. For EU users, this doesn't affect statutory warranties.

6.2 Limitation of Liability

To the maximum extent permitted by law, we aren't liable for indirect, incidental, special, or consequential damages (e.g., lost data, profits) from App use. Liability is limited to fees paid in the last 12 months. For EU users, this respects consumer protection laws (e.g., no limit for gross negligence).

6.3 Indemnification

You agree to indemnify us from claims arising from your App use, Terms violations, or third-party rights infringement.

7. Dispute Resolution

7.1 Governing Law

These Terms are governed by the laws of your jurisdiction (e.g., EU member state laws for EU users, California for US users), without conflict rules. For EU users, this includes consumer rights under EU directives.

7.2 Informal Resolution

Contact us at hi@stretcha.co to resolve disputes informally first—we'll respond promptly.

7.3 Dispute Process

For EU users, use Online Dispute Resolution (ec.europa.eu/odr) or your local consumer authority. No mandatory arbitration—we respect your right to court. For US users, disputes may go to small claims court; otherwise, resolved in your county.

8. Changes to Terms

We may update Terms with notice via email or in-app (30 days for material changes). Continued use accepts updates. Review periodically.

9. Miscellaneous

9.1 Entire Agreement

These Terms and our Privacy Policy form the full agreement, superseding priors.

9.2 Severability

Invalid provisions don't affect others.

9.3 Waiver

No waiver implies future waivers.

9.4 Assignment

You can't assign without consent; we can without restriction.
